The IRS has officially announced they will recognize same-sex married couples across all state lines. This is huge tax news. An LA Times article clarifies that these couples will be required to have been married in a state that recognizes same sex marriage, but the couple is not required to live in one of these 13 states. They may live in any state of the union and file a married filing joing or married filing separate return. However, if the couple resides in a state that doesn't recognize gay marriage they will still be required to file separate state returns.
The announcement also says that couples will be able to file amended returns for the last three years, which could lead to a nice surprise refunds. The IRS has also clarified that persons in a Registered Domestic Partnership (RDP) or Civil Unions will (still) not be eligible to file jointly (or separately) at the federal level.
